Terms and Conditions

                                                                                                    1.  PROVISIONAL BOOKING

1.1  WILL BE HELD FOR FIVE DAYS PENDING RECEIPT OF A COMPLETED BOOKING FORM AND FULL DEPOSIT OR PAYMENT AS APPROPRIATE.

1.2  ONLY THE PERSONS NAMED ON THE BOOKING FORM ARE ALLOWED TO STAY IN THE VILLA.  FLORIDA STATE LAW PROHIBITS SUBLETTING, SHARING OR ASSIGNING.

1.3  IF PERSONS NOT SHOWN ON THE BOOKING FORM ARE FOUND TO BE STAYING IN THE VILLA, THE WHOLE PARTY WILL BE ASKED TO LEAVE AND ALL MONIES WILL BE FORFEITED.

1.4  A RESPONSIBLE ADULT MUST ACCOMPANY PERSONS UNDER 25 YEARS OF AGE.

                                              2.  RESERVATION DEPOSIT/PROPERTY DAMAGE PROTECTION (PDP)

2.1  A RESERVATION DEPOSIT OF $200.00 PER WEEK RESERVED IS REQUIRED WITH YOUR COMPLETED BOOKING FORM.

2.2  CONFIRMATION OF BOOKING WILL NORMALLY BE MADE WITHIN SEVEN DAYS OF RECEIPT OF DEPOSIT.  ONCE BOOKING IS CONFIRMED, THE DEPOSIT WILL BE NON-REFUNDABLE, BUT WILL BE CREDITED TO THE FULL AMOUNT DUE.

2.3  A NON-REFUNDABLE FEE OF $69.00 WILL BE DUE WITH FINAL PAYMENT FOR PROPERTY DAMAGE PROTECTION INSURANCE (PDP).  THE PDP COVERS UP TO $3,000.00 IN UNEXPECTED, ACCIDENTAL OR OTHER DAMAGES TO THE VILLA AND/OR ITS CONTENTS.  THE VILLA WILL BE INSPECTED UPON DEPARTURE.

2.4  NOTWITHSTANDING THE AMOUNT OF THE PDP COVERAGE, GUEST IS LIABLE FOR ANY/ALL DAMAGE CAUSED TO THE VILLA DURING YOUR STAY.  THUS OWNERS RESERVE THE RIGHT TO PURSUE GUEST FOR FURTHER MONIES TO COVER MALICIOUS OR AVOIDABLE DAMAGE OVER AND ABOVE THE AMOUNT OF THE PDP COVERAGE.

                                                                                          3.  AT THE TIME OF CONFIRMATION

3.1  AN INVOICE WILL BE ISSUED SHOWING BALANCE DUE.  THIS IS DUE AND PAYABLE IN FULL EIGHT WEEKS PRIOR TO YOUR CHECK-IN DATE.

3.2  THE PDP FEE IS DUE WITH THE FINAL BALANCE.

3.3  OWNERS RESERVE THE RIGHT TO CANCEL RESERVATION IF FULL PAYMENT IS NOT RECEIVED WITHIN EIGHT WEEKS PRIOR TO ARRIVAL.  GUEST WILL FORFEIT DEPOSIT AND ANY OTHER MONIES PAID TO DATE.

3.4  BOOKINGS MADE WITHIN EIGHT WEEKS OF ARRIVAL ARE PAYABLE IN FULL BY CASH, MONEY ORDER OR CREDIT CARD AT THE TIME OF BOOKING.

3.5  FULL PROPERTY DETAILS AND KEY ENTRY DETAILS WILL BE PROVIDED WITHIN TWO WEEKS OF YOUR CHECK-IN DATE, PROVIDED FULL PAYMENT HAS BEEN RECEIVED AND CLEARED.

3.6  ANY STAY SHORTER THAN SIX NIGHTS WILL RESULT IN A CLEANING FEE.

                                                                                                    4.  CANCELLATIONS

4.1  THE GUEST MAY CANCEL THE BOOKING AT ANY TIME AFTER IT HAS BEEN CONFIRMED.  CANCELLATION MUST BE IN WRITING.  THE FOLLOWING
       CANCELLATION FEES WILL APPLY:

                    A.  MORE THAN EIGHT WEEKS BEFORE ARRIVAL DEPOSIT FORFEITED.
                    B.  BETWEEN FOUR AND EIGHT WEEKS BEFORE ARRIVAL 50% OF TOTAL RENTAL FORFEITED.
                    C.  LESS THAN 28 DAYS PRIOR TO ARRIVAL 100% OF TOTAL RENTAL FORFEITED.

                                                                                                      5.  AMENDMENTS

5.1  ANY ALTERATIONS(S) TO CONFIRMED BOOKING CAN BE MADE AT:

                                                                                               6.  ARRIVAL/DEPARTURE

6.1  RENTAL COMMENCES AT 4:00 PM ON THE DAY OF ARRIVAL AND CEASES AT 10:00 AM THE DATE OF DEPARTURE.  FAILURE TO VACATE THE PROPERTY BY THIS TIME WILL RESULT IN ADDITIONAL CHARGES. 

6.2  THE PROPERTY WILL BE CLEANED  PRIOR TO YOUR ARRIVAL AND AGAIN ON YOUR DEPARTURE.

6.3  ALL RENTALS ARE INCLUSIVE OF ELECTRICITY, WATER AND LOCAL SALES TAXES.

6.4  A TELEPHONE IS AVAILABLE FOR YOUR USE IN THE VILLA, WITH FREE LOCAL AND LONG DISTANCE CALLING WITHIN THE CONTINENTAL UNITED STATES AND CANADA.

                                                                                                     7FORCE MAJEURE

7.1  THE OWNERS CANNOT ACCEPT, BE RESPONSIBLE FOR, OR BE LIABLE WITH RESPECT IOF LOSS, DAMAGE OR CHANGE CAUSED BY FORCE MAJUERE (E.G.) STRIKES, FLOODS, CLOSURE OF AIRPORT, WEATHER CONDITIONS OR ANY OTHER EVENT(S) BEYOND OUR CONTROL.

7.2  IN THE UNLIKELY EVENT OF AN ISSUE/COMPLAINT ARISING DURING YOUR STAY, PLEASE CONTACT JCPS PROPERTIES, LLC.

                                                                                8. LIABILITY

8.1 THE OWNERS DO NOT ACCEPT ANY LIBILITY WHATSOEVER FOR DEATH, PERSONAL INJURY, ACCIDENTS, LOSS OR DAMAGE TO PERSON OR PERSONAL EFFECTS HOWEVER CAUSED.

8.2  PLEASE BEAR IN MIND THAT THE VILLA IS SITUATED IN A DEVELOPMENT THAT CONSISTS OF BOTH RESIDENTIAL AND VACATION HOMES.  THEREFORE, THE OWNERS CANNOT BE HELD RESPONSIBLE FOR ANY ONGOING CONSTRUCTION OR ALTERATIONS TO EXISTING HOUSES OR ANY NOISE AS A RESULT THEREOF ON OR AROUND THE HOUSING DEVELOPMENT.


                                                                                  9. POOL

9.1  IF POOL HEATING IS REQUIRED BY THE GUEST, THIS MUST BE REQUESTED AT THE TIME OF BOOKING.  THERE IS AN ADDITIONAL FEE FOR POOL HEAT AND MUST BE PAID IN FULL WITH THE FINAL BALANCE.  IN THE EVENT POOL HEAT IS REQUESTED AND PAID FOR, THE OWNERS CANNOT GUARANTEE THE TEMPURATURE OF THE POOL AS THIS WILL VARY ACCORDING TO MANY DIFFERENT FACTORS INCLUDING PREVAILING WEATHER CONDITIONS AND PROPER USE OF POOL BLANKET. 

9.2  IN THE UNLIKELY EVENT OF POOL HEATER BREAKDOWN, OR CIRCUMSTANCES BEYOND OWNER CONTROL, OWNER (OR OWNER REPRESENTATIVE) WILL  DO THEIR UTMOST TO RECTIFY THE PROBLEM AS SOON AS POSSIBLE.  IN SUCH AN EVENT OWNER LIABILITY WILL BE LIMITED TO REFUNDING POOL HEAT FEES FOR THE NUMBER OF DAYS THE HEATER WAS OUT OF ACTION ONLY - NO OTHER COMPENSATION WILL BE PAID.

9.3  SWIMMING POOLS ARE DANGEROUS.  THE VILLA POOL IS NOT TO BE USED BY CHILDREN WITHOUT ADULT SUPERVISION.

                                                                       10. INVENTORY ITEMS

10.1 NO INVENTORY ITEMS ARE TO BE REMOVED FROM THE VILLA.  THIS INCLUDES LINENS AND TOWELS.

10.2 GUESTS SHOULD CHECK THE PROPERTY AND REPORT ANY DAMAGE TO JCPS PROPERTIES, LLC. WITHIN 24 HOURS OF ARRIVAL.  iF DAMAGE IS UNREPORTED AND DISCOVERED DURING DEPARTURE CLEANING INPECTION, OWNERS WILL ASSUME DAMAGE WILL BE CURRENT GUEST RESPONSIBILITY.

10.3 ANY DAMAGE OR BREAKAGE MUST BE REPORTED TO JCPS PROPERTIES, LLC. IMMEDIATELY.

                                                                            11. INSURANCE

11.1 GUESTS ARE RECOMMENDED TO TAKE OUT ADEQUATE HOLIDAY INSURANCE TO COVER ALL EVENTUALITIES SUCH AS CANCELLATION, ACCIDENT, SICKNESS AND/OR DAMAGE.

                                                                      12. NO SMOKING POLICY

12.1 PLEASE NOTE THE VILLA IS A NON-SMOKING RESIDENCE.  SMOKING IS NOT ALLOWED WITHIN THE VILLA.  SMOKING IS ONLY PERMITTED OUTSIDE THE VILLA OR ON THE POOL DECK.  IF GUEST OR ANY OTHER VISITOR OF THE GUEST SMOKES IN THE VILLA THERE WILL BE AN ADDITIONAL $250.00 CLEANING FEE ACCESSED.

                                                                     13. BARBEQUE GRILL USE

13.1 THE VILLA IS EQUIPPED WITH AN OUTDOOR CHARCOAL BARBEQUE GRILL.  USE OF THE GRILL IS PERMITTED.  IT IS REQUIRED THAT THE GRILL NOT BE USED WITHIN THE POOL ENCLOSURE OR WITHIN THE GARAGE.  A $250.00 CLEANING FEE WILL BE ACCESSED IF GRILL IS USED WITHIN EITHER AREA.
